Important Notice: Please read these Terms of Service carefully before using Nova Photos. By using our App, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Welcome to Nova Photos, a mobile application provided by Yasphere Technology Limited ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Nova Photos application (the "App"), including any content, functionality, and services offered through the App.
By downloading, installing, or using Nova Photos, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
You must be at least 16 years old to use Nova Photos. By using the App, you represent and warrant that you are at least 16 years of age. If you are under 16, you may not use the App.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device for personal, non-commercial purposes.

Nova Photos provides the following features:
All photo and video processing is performed locally on your device. We do not upload your photos or videos to our servers.
Nova Photos offers both free and premium subscription plans. Premium features require a paid subscription. Subscription options and pricing are displayed within the App.
All payments are processed through Apple App Store. By purchasing a subscription, you agree to Apple's terms and conditions for in-app purchases.
Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period.
Refund requests are handled by Apple according to their refund policies. We do not have direct control over refund processing.
When using Nova Photos, you agree to:
The App and its original content, features, and functionality are owned by Yasphere Technology Limited and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain all rights to your photos and videos. We do not claim any ownership over your content.
Your use of Nova Photos is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our Privacy Policy.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific results from using the App.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YASPHERE TECHNOLOGY LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Yasphere Technology Limited and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or violation of these Terms.
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
You may terminate your use of the App at any time by uninstalling the App from your device.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date and, where appropriate, providing notice through the App. Your continued use of the App after any changes constitutes acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Hong Kong.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Yasphere Technology Limited regarding your use of the App and supersede any prior agreements.
